Power company will appeal Ga. court ruling that scuttled coal plant

ATLANTA -- A Georgia state judge's ruling yesterday that revoked air pollution permits for a coal-fired power project gave the electric power sector its first loss in the ongoing battle between industry groups and environmentalists over whether utilities' greenhouse gas emissions are subject to regulation under the Clean Air Act. Developers of the south Georgia project said today they will appeal the ruling to the Georgia Court of Appeals, while industry lobbyists in Washington sought to downplay the ruling's relevance to similar cases in other jurisdictions.
