Justices will hear two Clean Water Act cases
Ignoring the advice of the Obama administration, the Supreme Court today decided to take up two Clean Water Act cases, including a high-profile dispute over whether stormwater washing off logging roads is subject to permitting. That case, which came to the court in two related petitions -- Decker v. Northwest Environmental Defense Center and Georgia-Pacific West Inc. v. Northwest Environmental Defense Center -- has already generated considerable interest in Congress and prompted U.S. EPA to announce plans to pursue a rulemaking on the issue. The second case the court agreed to review, Los Angeles County Flood Control District v. Natural Resources Defense Council, concerns whether the Los Angeles County Flood Control District is liable for the discharge of polluted stormwater into two rivers.
