Obama admin to vacate 3.7M acres of seabird's critical habitat

The Obama administration has agreed to vacate 3.7 million acres of critical habitat for the threatened marbled murrelet as part of a settlement agreement with the timber industry. The American Forest Resource Council sued Interior officials in January, arguing that the 2011 critical habitat designation violated the Endangered Species Act by including areas not occupied by the North Pacific seabird at the time it was listed in 1992.
