A federal appeals court today ruled that President Obama exceeded his constitutional authority when he appointed three members to the National Labor Relations Board because the Senate technically was not in recess at the time. The U.S. Court of Appeals for the District of Columbia Circuit's unanimous ruling is a serious blow to the Obama administration and could invalidate all of the labor board's decisions since.
