Appeals court rejects industry challenge to Calif. low-carbon fuel standard
The 9th U.S. Circuit Court of Appeals rebuffed a challenge from industry today to California's low-carbon fuel standard in a victory for the state's efforts to curb emissions of greenhouse gases. The judicial panel ruled 2-1 that the California Air Resources Board's regulations didn't violate the Constitution's Commerce Clause by penalizing out-of-state fuels.
