Court backs EPA ozone limit but orders review of public welfare standard

Federal judges today upheld U.S. EPA's ozone standard in a challenge from public health groups that said the agency ignored a scientific consensus pointing to a stricter limit. But the U.S. Court of Appeals for the District of Columbia Circuit sent the secondary National Ambient Air Quality Standard back for agency review, holding that EPA erred in setting the secondary standard that was identical to the primary.
