8th Circuit rejects request to stop EPA effluent rule

A federal appeals court in Missouri has declined to halt EPA’s rule on wastewater discharges from power plants.

In a succinct order issued Thursday, the 8th U.S. Circuit Court of Appeals rebuffed a request from Republican-led states and power companies to stop the coal wastewater rule from taking effect while litigation against it proceeds.

“The motion for stay is denied,” the court wrote.

EPA’s rule, finalized in May, revises pollution limits for coal-fired power plants, which can spew heavy metals and other contaminants into the nation’s waterways. The agency has estimated that the rule would reduce pollution discharges by at least 660 million pounds per year.
