Chemical company drops challenge to EPA asbestos ban

Olin dropped its petition against EPA’s asbestos ban ahead of oral arguments in federal court next month.

One of three U.S. companies that still use asbestos in manufacturing backed off Wednesday from its challenge against the EPA asbestos ban.

With Olin dropping its petition, the American Chemistry Council and three state chemical associations remain as challengers to the rule.

The 5th U.S. Circuit Court of Appeals has scheduled oral arguments on the rule for June 1.

The Trump administration announced last summer it would defend the Biden-era rule, which triggers a staggered phaseout of asbestos in industrial processes by 2037.
