Enviros contest EPA air rule, but its fate rests with Trump

Environmental advocates are mounting a two-pronged challenge to a facet of the Biden administration’s reworking of a long-standing set of industrial air pollution curbs.

The incoming administration of President-elect Donald Trump will likely have the last word, however.

In a newly submitted petition, the Environmental Defense Fund and three other organizations ask EPA to administratively strengthen the rule released in September requiring some industries to permanently abide by the “maximum achievable” hazardous pollutant standards regardless of their regulatory status.

As a backup, they have also brought a fresh lawsuit before the U.S. Court of Appeals for the District of Columbia Circuit.
