Michigan court upholds Line 5 segment replacement plan

A three-judge panel ruled that the state Public Service Commission had adequately analyzed the proposal to place part of the oil conduit in a concrete tunnel.

A Michigan court declined this week to order further review of state regulators’ approval of a plan to replace part of the contested Line 5 oil pipeline beneath the Straits of Mackinac.

The decision Wednesday from the Michigan Court of Appeals hands a win to project developer Enbridge Inc. and the Michigan Public Service Commission, which gave the green light in 2023 for the company to replace a four-mile dual pipeline segment with a pipe enclosed in the planned Great Lakes Tunnel.

“The PSC issued a comprehensive and detailed opinion,” the court wrote in an opinion.”We find no basis for ordering a reversal or remand. The Commission acted reasonably when one considers its actions and rulings as a whole.”

Judges Michael Kelly, Anica Letica and Randy Wallace decided the case. None of the judges asked questions during a hearing last month.
