North Dakota is urging a federal court to toss out a Biden-era plan to limit fossil fuel and mineral resources development on federal lands within the state’s borders.

The Interior Department’s Bureau of Land Management finalized North Dakota’s resource management plan, or RMP, in January — despite state officials’ repeated objections that the agency had improperly prioritized land conservation at the expense of state interests.

“The Amended RMP shreds the spirit of the State-federal cooperation to impose draconian and irrational restrictions on the development of traditional energy resources that will affect the State for decades to come,” said North Dakota Attorney General Drew Wrigley (R) in a lawsuit filed Tuesday in the U.S. District Court for the District of North Dakota.

He called for the court to issue either a preliminary or permanent injunction to block the RMP.
