Developers of the Pebble mine in Alaska’s pristine Bristol Bay watershed are expanding an ongoing lawsuit against EPA, which vetoed the project last year, to also target the Army Corps of Engineers.
Canada-based Northern Dynasty Minerals and Pebble, a subsidiary of Dynasty, moved on Monday to amend their lawsuit — originally filed in March in the U.S. District Court for the District of Alaska — to include the Army Corps.
While the original lawsuit was filed against EPA for issuing a rare veto of the project under the Clean Water Act last year, the companies argue that the Army Corps is also at fault for denying the project a critical permit years prior, in the fall of 2020.
Targeting both agencies, they argue, will strengthen their legal case. The Army Corps did not immediately respond when asked about the lawsuit.
