Red states follow Trump’s fight against climate superfund law in Vermont

Twenty-four Republican attorneys general on Friday put their weight behind an industry lawsuit challenging Vermont’s “climate superfund” law.

Led by West Virginia Attorney General JB McCuskey, the coalition of GOP officials is seeking to join an existing lawsuit in the U.S. District Court of Vermont by the American Petroleum Institute and the U.S. Chamber of Commerce. They’ve asked the court to stop enforcement of the law and declare it unconstitutional, along with recovering the costs of litigation.

The new action came a day after the Trump administration sued Vermont and New York over their climate superfund laws. In February, Republican state officials and industry groups sued New York over its law. It’s not clear why the coalition waited nearly three months to sue Vermont.

McCuskey, whose office did not immediately respond to questions, lauded the Trump administration’s lawsuit in a statement.
