The Senate on Monday advanced the nomination of Eric Tung to serve on the 9th U.S. Circuit Court of Appeals, which often hears energy and environment cases.
Tung, a partner at the firm Jones Day, received no support from Democrats during a procedural vote Monday. A final roll call is expected Tuesday, along with a final vote on Joshua Dunlap to serve on the 1st U.S. Circuit Court of Appeals.
Tung would be President Donald Trump’s 11th appointment to the San Francisco-based 9th Circuit, but the first of his second term. The 1st Circuit currently has no Republican appointees handling a full caseload.
Democrats have expressed concern about Tung being a conservative ideologue and questioned previous writings on gender roles. When it comes to Dunlap, concerns have come from abortion and LGBTQ advocates.
