Senate sets vote on resolution to revive pollution limits

Senate Democrats are using the Congressional Review Act to spotlight energy and affordability issues ahead of the midterms.

Senate Democrats are forcing a vote as soon as Wednesday on legislation that would undo a Trump administration action against a Colorado pollution plan.

Led by Sen. Michael Bennet (D-Colo.), S.J.Res.139 has no chance of becoming law, but comes as Democrats force several votes using the Congressional Review Act to spotlight energy and affordability issues ahead of the midterms. The CRA lets lawmakers undo newly-issued rules by simple majority.

Bennet’s legislation would repeal a Trump EPA effort to quash Colorado’s program for addressing regional haze to improve visibility. The program included emissions limits for polluters and coal plant retirements.

In a statement late last year, an EPA spokesperson argued clean air and energy production are not mutually exclusive.
