Supreme Court books case challenging Calif. emissions waiver

The Trump administration had pushed to put the case on ice as it reviews the waiver, but the court denied the request.

The Supreme Court will hear arguments in April over a challenge to California’s long-standing authority to set strict tailpipe emissions for vehicles.

The court on Monday said it will hear Diamond Alternative Energy v. EPA on April 23. The hearing comes as the court earlier this month rejected the Trump administration’s efforts to pause proceedings in the case.

The court did give the administration more time to file briefs in the case, which are now due March 12.

Oil and biofuel industry lawyers have asked the justices to yank California’s decades-old waiver, arguing that the state should not be given special privileges to set greenhouse gas emissions standards that are stronger than the federal government’s.
