Supreme Court denies challenge to Mountain Valley pipeline

The case focused on a procedural hurdle in Virginia landowners’ fight against natural gas pipeline developers’ power to take private land.

The Supreme Court on Monday denied Virginia landowners another chance to fight federal approvals for the Mountain Valley pipeline and other natural gas projects.

The court order rejecting the case did not offer any explanation for the justices’ decision and comes just days before the pipeline’s developers have asked federal energy regulators to authorize the pipeline to go into service.

Cletus and Beverly Bohon had arrived at the Supreme Court seeking a new lifeline for the small group of landowners in the pipeline’s path, who have argued that the Federal Energy Regulatory Commission should not have the power to allow natural gas project developers to take private property.

The Bohons have claimed that FERC’s current approach is unconstitutional and aimed to remake how the independent agency authorizes new gas infrastructure.
