The Supreme Court on Monday declined to hear a mining company’s claims that federal nuclear safety regulations shielded it from liability under Missouri law for radioactive contamination.

The court’s decision is a win for two sisters — Nikki Mazzocchio and Angela Steiner Kraus — who had sued Cotter Corp., alleging the company’s processing of nuclear waste from the Manhattan Project contaminated a creek near their St. Louis-area apartments and caused their blood cancer diagnoses.

Victor Cobb, an attorney with the Cooper Law Firm, representing the sisters, praised the court’s decision to reject the petition.

“We’ve been litigating this case for these two sisters for years now, and it’s about time that we can get back to district court and try and get them the justice they deserve,” Cobb said.
