The Trump administration is asking the nation’s highest bench to halt a court order that blocked one of the new president’s efforts to shrink the federal workforce.
In an emergency application filed Monday, acting Solicitor General Sarah Harris said the administration is likely to succeed on the merits of its effort to fire thousands of “probationary” employees at federal agencies like the departments of the Interior and Energy — despite preliminary lower court orders blocking those actions.
The terminations generally apply to federal workers who have served in their jobs less than one or two years.
The government’s application stems from a legal fight in a federal court in California, which the Trump administration fought earlier this month in the 9th U.S. Circuit Court of Appeals.
