EPA’s internal watchdog found the agency’s special agents need to strengthen their training to reduce chances of undermining criminal cases.
The report, released Thursday, comes while the Biden administration bolsters efforts to revitalize its enforcement program.

EPA’s Office of Inspector General uncovered some risks in how special agents for the agency handle criminal evidence in their investigations. The watchdog office warned EPA to take greater care so it can avoid overturned convictions and retried cases in the future.
“Strengthening EPA discovery policies and procedures can promote efficient and effective criminal prosecution,” said the report, adding the agency’s Office of Criminal Enforcement, Forensics and Training “has opportunities to strengthen its processes and further reduce risks of not fulfilling discovery obligations.”
