Youth climate activists say Trump order boosts their case

Attorneys for young California climate activists are citing an unusual source to bolster their lawsuit against EPA: President Donald Trump’s Day 1 executive order on energy.

Our Children’s Trust, the Oregon-based law firm that represents the youth, on Thursday asked a federal judge to take notice of Trump’s “Unleashing American Energy” order in a bid to keep the case alive.

Judge Michael Fitzgerald of the U.S. District Court for the Central District of California last May scrapped the lawsuit, but did give the youth one more opportunity to revise their complaint.

The case, Genesis v. EPA, claims that the agency has “forged an unlawful path” by failing to keep climate pollution at a level that protects children, who are more vulnerable than adults to rising temperatures, raging wildfires and other effects of a warming planet.
