Mine safety official sues Trump for ‘unlawful’ firing

This is the first time a president has tried to remove a sitting member of the Federal Mine Safety and Health Review Commission, according to the lawsuit.

A member of the Federal Mine Safety and Health Review Commission on Thursday sued President Donald Trump and other White House officials for attempting to fire him.

Moshe Marvit, a Democratic appointee to the panel, filed the lawsuit in the U.S. District Court for the District of Columbia. Marvit is asking the court to reverse what he says is an “unlawful and unjustified purported termination” and allow him to complete his term through August 2028.

Marvit, according to the suit, received an email from Special Assistant to the President Sarah Calvis on May 1, informing him that his “position as Federal Mine Safety and Health Review Commissioner is terminated, effective immediately.” The email did not cite grounds for Marvit’s termination, according to the suit.

President Joe Biden nominated Marvit, and he was confirmed by the Senate in 2024. His nomination had for years been delayed on Capitol Hill amid fights over presidential nominations. Biden previously nominated him in 2022 and 2023, but the full Senate never acted.
