Court brushes aside challenge to biogas rules

The U.S. Court of Appeals for the District of Columbia Circuit sided with EPA on a dispute about new biogas regulations in the renewable fuel standard.

A federal court Friday rejected a natural gas industry group’s fight against EPA’s effort to revamp how producers are wrapped into federal biofuel-blending regulations.

A three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit denied the Coalition for Renewable Natural Gas’ challenge to EPA’s 2023 regulations that imposed new reporting requirements on renewable natural gas producers.

In the opinion for the court, Circuit Judge Patricia Millett said EPA’s changes were “reasonable and supported by substantial evidence” and brushed aside all nine objections the industry group had made in court filings.

The RNG Coalition’s director of federal government affairs, Geoff Dietz, said in a statement, “RNG Coalition is disappointed in the Court’s decision, and we continue to review it to determine any potential next steps. We continue to work closely with EPA on ensuring the reforms are enacted in the most sensible and efficient way possible.”
