DC Circuit environment and energy cases to watch

Starting this week, the nation’s second-highest court is slated to hear battles over gas infrastructure, climate policy and agency deference.

The nation’s most powerful federal appeals court is back in action this week.

On the docket for the U.S. Court of Appeals for the District of Columbia Circuit are arguments in cases involving federal environmental reviews of gas pipelines, EPA chemical analyses and the phasedown of a potent climate pollutant.

Later this fall, the court will suss out the ramifications of the demise of the Chevron doctrine for regulation of the herring fishing industry in Loper Bright v. Raimondo — a case the Supreme Court sent back to the D.C. Circuit earlier this summer after deciding that judges no longer need to defer to agencies’ reasonable readings of ambiguous laws.
