EPA asks court for more time in PFAS litigation

Water experts have been expecting more details on EPA’s regulatory plans but will have to wait at least a few weeks longer.

EPA will move forward with defending Biden-era limits on some forever chemicals in drinking water, the agency said in a court filing Monday.

But as it has done since May, when Administrator Lee Zeldin said he will keep limits set for PFOA and PFOS but revisit those for four other compounds, the agency revealed no new details about its plans.

Instead, EPA said it and the water and chemicals industry groups challenging the standards need until Aug. 1 to come up with a schedule for additional briefing, which was suspended earlier this year while EPA considered what to do.

“The parties are continuing to confer regarding a proposed format and schedule for completion of briefing in these consolidated cases, including an additional filing to be submitted by the United States, but at this time have not reached agreement on a proposal,” the agency wrote. “The modest additional time requested will allow the parties to attempt to resolve or narrow any differences regarding how to proceed.”
