New York governor affirms state power over renewable taxation

Gov. Kathy Hochul signed a measure bolstering the state’s authority to limit local property tax assessments on new wind and solar projects after local governments challenged the policy.

ALBANY, New York — The state can continue to limit how much local governments tax new renewables under a measure Democratic Gov. Kathy Hochul signed Wednesday.

The legislative fix seeks to resolve a long-running legal battle over who gets to decide the property tax assessment level for new solar and wind projects. Local governments first challenged the state’s authority over such assessments in 2022.

Why it matters: Hochul has acknowledged New York will fail to meet its 2030 renewable target, but she’s still pushing to make progress. The state and renewable developers are racing to speed construction of projects to meet a federal deadline in July to qualify for key tax credits.

Those that don’t qualify would see higher costs and might not secure state contracts for subsidies.
