Senate moves to scrap California EPA waivers

Leaders have decided to defy the parliamentarian to kill car emissions rules.

The Senate will move to undo EPA approval for California’s latest vehicle emissions rules meant to encourage the adoption of electric vehicles.

Republicans are trying to kill the rules by undoing Biden administration Clean Air Act waivers through the Congressional Review Act.

The CRA allows Congress to repeal newly issued agency rules by simple majority. Because the Government Accountability Office and the Senate parliamentarian have said the waivers are not rules under the law, moving ahead means defying the parliamentarian.

“If we don’t act, the consequences to our economy, to consumers and to our electricity supply could be devastating,” Senate Majority Leader John Thune (R-S.D.) said Tuesday morning on the Senate floor.
