Senate sets vote on resolution targeting Trump EPA rule

Democrats are trying to turn the tables on Republicans with the Congressional Review Act.

The Senate is expected to vote Tuesday on legislation that would undo the Trump administration’s rule allowing more pollution from Indiana coal power plants.

S.J.Res. 60, from Environment and Public Works Committee ranking member Sheldon Whitehouse (D-R.I.), targets an EPA interim final rule published in May. It loosened the yearly emissions allowance of nitrogen oxide from Indiana plants during the summertime ozone season.

The resolution, filed under the Congressional Review Act, is one of several Democratic measures targeting the administration’s early environmental agenda, which has focused on regulatory rollbacks.

The Congressional Review Act allows lawmakers to undo recently finalized rules and other administration actions by simple majority. Republicans killed a number of Biden-era actions using the law.
