The Senate on Thursday approved legislation targeting a Biden-era rule aimed at limiting industrial emissions of mercury, PCBs and other hazardous pollutants.

S.J. Res 31, from Sen. John Curtis (R-Utah), would repeal Clean Air Act regulations issued last September as a replacement for the “once in, always in” policy that was scrapped in 2020 during President Donald Trump’s first term.

The replacement rule was more narrowly tailored but still requires industries to abide by strict pollution-control requirements for some air toxics even if their emissions fall below thresholds that triggered those standards to start with.

Business groups and GOP lawmakers have long contended that such requirements act as a disincentive for cutting hazardous air releases.
