Talen urges court to reverse FERC order on nuclear power for data center

Talen Energy is making its case for why an appeals court should reverse a Federal Energy Regulatory Commission order preventing an Amazon data center from getting its power directly from a Pennsylvania nuclear power plant.

In a brief filed this week, Talen Energy claimed a divided commission had improperly rejected an interconnection agreement for its Susquehanna nuclear power plant, which would help to power artificial intelligence and cloud technologies at the data center.

“FERC’s orders in this important case rest on a series of fundamental legal errors, any one of which would be sufficient to warrant vacatur,” Talen Energy’s attorneys told the 5th U.S. Circuit Court of Appeals on Monday.

If the order isn’t tossed out entirely, they added later, the court should at least send the order back to FERC for more analysis to explain its reasoning. The case is consolidated with a similar challenge by Talen Energy filed in January.
