Trump admin signals position changes in SCOTUS environment cases

The Trump administration is getting ready to flip the federal government’s position in pending Supreme Court climate and energy cases.

In a string of notices Friday, acting Solicitor General Sarah Harris asked the justices to either hold off on deciding or take into account new developments in three key environmental cases pending before the high court. The Department of Justice also called for similar delays in the lower courts.

Litigation freezes are typical at the start of a new administration, said James Coleman, a law professor at the University of Minnesota.

“Although it is normal to have a bunch of these requests,” he said, “we are probably getting more of these each transition.”
