EPA advises back pay for furloughed staff. The White House doesn’t.

The agency will follow a law enacted during the first Trump administration, according to guidance posted on its website.

EPA guidance states its staff furloughed during the federal government shutdown will receive retroactive pay, contradicting statements made by the White House this week.

In a “Frequently Asked Questions” document regarding a lapse in appropriations, EPA said it will follow a law signed by President Donald Trump after the 2019 shutdown. That measure ensures federal employees will be paid once a shutdown is over and funding is restored.

“Am I guaranteed pay once the government reopens?” said the document, which is hosted on EPA’s website.

“Yes,” answered the guidance, adding, “In 2019, Congress enacted the Government Employee Fair Treatment Act. The law guarantees back pay to employees who are not paid as a result of a government shutdown.”
